Allgemeine Geschäftsbedingungen (AGB)
1. Geltungsbereich
Diese AGB gelten für sämtliche Dienstleistungen und Verkäufe durch Evolution by Pilates (Inhaberin: Ka Yan Sabrina Ng), Ehinger Str. 19, 89077 Ulm.
2. Vertragsschluss & Zahlung (100 % Bargeldloses Studio)
Buchungen erfolgen über die Plattform Eversports oder für Wellpass-Mitglieder direkt über die Wellpass-Website bzw. App. Der Vertrag kommt mit der Buchungsbestätigung zustande. Evolution by Pilates ist ein bargeldloses Studio. Alle Zahlungen vor Ort (z. B. Wellpass-Zuzahlungen, Drop-Ins, Socken) erfolgen via SumUp.
Akzeptierte Zahlungsmittel: Visa, Mastercard, American Express, Maestro, V PAY, Apple Pay, Google Pay.
Sollten Teilnehmer ohne Karte zum Kurs erscheinen, wird die Gebühr per Rechnung nachgefordert.
3. Leistungen & Gültigkeit
Alle Preise verstehen sich inklusive der gesetzlichen MwSt.
- Drop-In: 1 Besuch, Verfall nach 3 Monaten.
- Probemonat: 4 Besuche / 1 Monat (nur Neukunden).
- 10er-Karte: 10 Besuche, Verfall nach 3 Monaten ab Erstnutzung.
- Monats-Abos (4x, 8x, Unbegrenzt): Mindestlaufzeit 6 Monate, danach monatlich kündbar.
4. Stornierung & Verspätung (Late Cancellation Policy)
Stornierungen müssen bis spätestens 12 Stunden vor Kursbeginn über die jeweilige Buchungsplattform (Eversports oder Wellpass) erfolgen.
- Punktekarten / Limitierte Abos: Bei verspäteter Absage (< 12 Std.) oder Nichterscheinen wird der Credit abgezogen.
- Unlimited-Mitglieder: Es wird eine Ausfallgebühr in Höhe eines Drop-In Preises berechnet. Bei 3 Verstößen pro Monat folgt eine 7-tägige (bei weiteren Verstößen 14-tägige) Buchungssperre.
- Wellpass-Nutzer: Es fällt eine Zuzahlung (Co-payment) von 5,00 € pro Buchung an.
- Da Wellpass nur einen Check-in pro Tag erlaubt, wird jede weitere Teilnahme am selben Tag zum regulären Drop-In Preis berechnet. Bei wiederholten Verstößen gegen die Stornierungsfrist behält sich das Studio eine offizielle Beschwerde bei Wellpass vor.
5. Warenverkauf (Socken)
Der Verkauf erfolgt via Click & Collect oder vor Ort per Karte. Rückgabe/Umtausch ist aus Hygienegründen nur bei ungetragener und ungewaschener Ware möglich.
6. Verspätungen & Studio-Regeln
Einlass ab 15 Min. vor Beginn. Die Studiotür schließt pünktlich. Nach Kursbeginn ist kein Einlass möglich; der Credit verfällt bzw. Gebühren gemäß Punkt 4 werden fällig.
7. Gesundheit & Haftung
Teilnahme auf eigene Gefahr. Verletzungen oder eine Schwangerschaft sind dem Trainer vorab mitzuteilen.
8. Widerrufsrecht
Verbrauchern steht ein 14-tägiges Widerrufsrecht bei Online-Käufen zu, sofern die Leistung noch nicht vollständig erbracht wurde.
General Terms and Conditions (T&Cs)
1. Scope of Application
These General Terms and Conditions (GTC) apply to all services and the sale of goods (e.g., Pilates socks) provided by Evolution by Pilates (Owner: Ka Yan Sabrina Ng), Ehinger Str. 19, 89077 Ulm.
2. Contract & Payment (100% Cashless Studio)
Bookings are made via Eversports or, for Wellpass members, directly through the Wellpass website or app. The contract is finalized upon booking confirmation. Evolution by Pilates is a 100% cashless studio. All on-site payments (e.g., Wellpass co-payments, Drop-Ins, socks) are handled via SumUp.
Accepted Payment Methods: Visa, Mastercard, American Express, Maestro, V PAY, Apple Pay, Google Pay.
If a participant arrives without a card, an invoice will be issued for the outstanding fee.
3. Services & Validity
- Single Class (Drop-In): Valid for one visit; expires 3 months from the date of purchase.
- Trial Month: Valid for 4 visits within 1 month from the first booking (new customers only).
- 10-Class Pass: Valid for 10 visits; expires 3 months from the first booking.
- Monthly Memberships (4x, 8x, Unlimited): These contracts renew automatically every month. A minimum term of 6 months applies. Regular termination is possible for the first time at the end of this minimum term.
4. Cancellation & Lateness Policy Cancellations must be made via the respective booking platform (Eversports or Wellpass) at least 12 hours before class.
- Class Passes / Limited Memberships: Late cancellations (< 12 hours) or no-shows result in credit forfeiture.
- Unlimited Members: A late fee equal to a Single Drop-In will be charged. 3 offenses per month lead to a 7-day (later 14-day) booking ban.
- Wellpass Users: A 5.00 € co-payment applies per booking.
- As Wellpass only covers one check-in per day, any second session on the same day will be charged at the standard Drop-In price. Repeated late cancellations or no-shows will result in an official complaint to Wellpass.
5. In-Studio Retail Sales
Retail Sales & Refunds Items (e.g., socks) can be purchased online or directly at the studio with card payment. Due to hygiene reasons, refunds or exchanges are only accepted if the item is unworn and unwashed.
6. Lateness & Studio Rules
Entry to the studio is possible from 15 minutes before the start of the class. To avoid disrupting the ongoing class, the studio door will be closed punctually at the start of the class. Entry after the class has started is not permitted; the class credit will be forfeited in this case.
7. Health & Liability
Participants are required to inform the instructor of any injuries, physical limitations, or pregnancy before the start of the class. Participation is at your own risk. The studio's liability for property damage and personal injury is limited to intent and gross negligence.
8. Right of Withdrawal
Consumers have a 14-day right of withdrawal for online purchases of passes/memberships. The right of withdrawal expires prematurely if the service has been fully rendered at the request of the customer.
